Privacy statement Ghelamco Group

Ghelamco Group, a company under Belgian law (“commanditaire vennootschap op aandelen”), having its registered office at Zwaanhofweg 10, 8900 Ieper, and registered under the number 0879.623.417, RPR Ghent (“Ghelamco”, “we”, “us”), takes the protection of your privacy very seriously and processes your personal data in accordance with this privacy statement (“Privacy statement”).

This Privacy statement applies to the processing of personal data on this website, but also to processing in the context of contacts and/or contracts we have with you or your company as a customer, supplier or otherwise.

Ghelamco does not take its responsibility as data controller lightly. Ghelamco therefore handles your personal data in a responsible manner. For this reason, your personal data will always be carefully processed and secured in accordance with the applicable regulations, such as the General Data Protection Regulation of 27 April 2016 (“GDPR”).

Which personal data does Ghelamco process?

Ghelamco processes the following personal data:

  • Identification and contact details (e.g. name, date of birth, address, (mobile) telephone number, email address);
  • Financial data (e.g. for solvency checks);
  • Our website uses cookies in accordance with our Cookie Statement.

Why does Ghelamco process the personal data?

The personal data is being processed for the purposes of customer and contract management and Ghelamco’s dispute management.

The processing activities (in the context of customer and contract management) are necessary for the performance of the agreement if we have concluded the relevant agreement directly with you.

If we have entered/are about to enter into the relevant agreement not directly with you, but with your company, the related processing is based on our legitimate interest, i.e. being able to enter into/perform the necessary services in relation to that agreement with your company.

We process your data in order to safeguard our dispute management. These processing activities are based on our legitimate interest in defending ourselves and providing evidence in potential future disputes.

When you enter your contact details on our web form, for instance to obtain more information about one of our projects, you consent to us using these details to contact you.

We may also use your personal data for direct marketing (sending newsletters). If you are not an existing customer (processing on the basis of the so-called “soft opt-in”, to which you can object at any time), we always ask for your permission.

With whom does Ghelamco share the personal data?

Where relevant in the context of the relationship with you (e.g. for the provision by Ghelamco Invest of certain services), Ghelamco may also share your personal data with Ghelamco Invest. The processing by Ghelamco Invest will then be carried out in accordance with the Ghelamco Invest Privacy statement.

Ghelamco may use other service providers to process personal data, which will then act as a data processor (e.g. in the context of CRM: SalesForce, Mailchimp…). They may only process personal data on behalf of Ghelamco. To this end, Ghelamco will enter into a data processing agreement with them, in which they are obliged to comply, amongst others, with all legal provisions and the provisions of this Privacy statement.

Ghelamco may also share your personal data with internal or external brokers, but will only do so to the extent necessary to provide information requested by you about the specific projects for which you have contacted us through the web form.

Ghelamco may share personal data with the relevant public authorities and the police when necessary to ensure, amongst others, the security and safety of you and third parties or when Ghelamco is obliged to do so in accordance with a statutory provision or an administrative or judicial decision.

In principle, your personal data will only be processed within the European Economic Area. In the event the personal data are nevertheless processed outside the European Economic Area, appropriate measures will be taken to ensure adequate protection (e.g. by signing Standard Contractual Clauses with the recipients). For how long does Ghelamco retain the personal data?

Ghelamco will only retain your personal data for as long as is necessary for the purposes described under point 3 of this Privacy statement. In this way, we also prevent irrelevant information from being retained. As the contractual liability claim only expires after 10 years, we will archive certain data during this period for this purpose only. As you can see below, you can ask us to delete certain data at any time. Ghelamco will always comply with this request if the legal conditions to do so are fulfilled.

What are your rights with regard to the personal data?

You have the right to access (and receive a copy of) the personal data that Ghelamco holds of you.

You have the right to have your personal data corrected if it is inaccurate or outdated and/or supplemented if it is incomplete.

You have the right to object, with justification, to the processing of your personal data where it is based on a “legitimate interest” of Ghelamco (or a third party) as specified above. In this event, Ghelamco will cease the processing of your personal data unless Ghelamco provides compelling legitimate grounds for processing which outweigh your interests, rights and freedoms or those related to initiating, executing or substantiating of a legal claim.

In principle, you have the right to obtain the personal data you have provided to Ghelamco in a structured, commonly used and machine-readable format and to transfer it to another data controller.

In principle, you have the right to request Ghelamco to delete your personal data. You also have the right to request that the processing of your personal data is merely restricted (e.g. making personal data inaccessible).

There are exceptions to all of these rights. For instance, all requests may be refused if they are manifestly unjustified or excessive. Certain rights have additional exceptions: for instance, the right to erasure (deletion) does not apply if the processing is necessary for initiating, executing or substantiating of a legal claim.

What in case of modifications of the Privacy statement?

Ghelamco reserves the right to modify this Privacy statement at any time. It is your responsibility to review the applicable Privacy statement on a regular basis and to comply with the latest version. This Privacy statement was last amended and revised on 08/02/2021.
